Although the word appliques is used in the U.S. marketplace to refer to a variety of goods in multiple classes, including clothing patches, decals, and vinyl or rubber adhesive strips and tapes, the wording Appliques [haberdashery] was added to the Nice Alphabetical List in Class 26, effective January 1, 2013, thereby limiting the meaning of the word appliques to clothing decorations, such as fabric patches, when it appears in International applications for registration. Therefore, applicants who intend to apply for an Extension of Protection under the Madrid Protocol should consider limiting their use of the term appliques to Class 26 because including this term in other classes may result in a Notice of Irregularity.
