10-07-2010 - Auditing is in the Nice Agreement's Alphabetical List in 35; therefore, business auditing, energy auditing, and real estate transaction auditing are in Class 35. Effective Jan. 1, 2013, the Nice Alphabetical List entry "Auditing" in Class 35 was amended to "Business auditing," and "Energy auditing" was added to the Alphabetical List in Class 42. Real estate transaction auditing services remain in Class 35 because they involve financial accounting and other business-type activities in Class 35. Effective Jan. 1, 2013, auditing services are classified in Class 35 when they involve accounting and other business-type activities, and auditing services are classified in Class 42 when they involve technical analysis and evaluation. The subject matter being audited does not determine classification.
