Transmission of audio and video tethered downloads are telecommunications services, not content-based services. Transmission services are classified in Class 38 based on the nature of the activity, and not according to the subject matter of the material being transmitted. For information about identifying and classifying telecommunications services, see TMEP §1402.11(a)(iii). Tethered downloads are computer files that feature conditions or limitations as to the use of the files, such as restrictions in the ability to copy the files or requirements for periodic payments to use the files.
