Rental services are in principle classified in the same classes as the services provided by means of the rented objects. See Nice General Remarks in TMEP §1401.02(a). Play yards in the nature of outdoor play structures are considered playground equipment for the amusement or recreation of people rather than as a confinement system for small children. These services are classified in Class 41 by analogy to "games equipment rental" in the Nice Alphabetical List in Class 41. See also "Rental of play yards for babies" in Class 43.
