03-20-2025 - Rental of drink dispensing machines refers to rental of automated dispensing machines that typically mix concentrate with one or more other ingredients and dispense the resulting mixture into an open container as a ready-to-drink beverage. Rental services are in principle classified in the same classes as the services provided by means of the rented objects. See Nice General Remarks in TMEP §1401.02(a). Rental of drink dispensing machines is classified in Class 43 by analogy to "services for providing food and drink" in the Class 43 Nice Class Heading. "Rental of vending machines" is classified in Class 35 because "the bringing together, for the benefit of others, of a variety of goods, excluding the transport thereof, enabling customers to conveniently view and purchase those goods; such services may be provided by retail stores, wholesale outlets, through vending machines, mail order catalogues or by means of electronic media, for example, through websites or television shopping programmes" appears in the Class 35 Nice Explanatory Note.
