05-01-2005 - This entry was transferred from Class 42 to Class 44 due to the restructuring of Class 42 that was implemented in the 8th edition of the Nice Agreement. 09-11-2008 - This service is for the collection and provision of organs and tissues for medical purposes. Other aspects of such a bank are ancillary - processing, treatment, storage, etc. - and would be in other classes such as 39 or 40 if specified as a separate activity of the bank. Also, if the purpose of the bank is to provide organs and tissues for research or education purposes, the service would be in Class 42 with a clear specification of that limitation. 01-01-2025 - The policy regarding classification of these banks by purpose referenced in the prior Note of 09-11-2008 is no longer in effect. These services are classified in Class 44 notwithstanding the purpose of the bank because "cultured cell bank services for medical transplantation," "human tissue bank services," and "medical treatment using cultured cells" appear in the Nice Alphabetical List in Class 44.
