Hydroponic farming is a method of growing plants without the use of soil, by using water through which nutrients are pumped. To be a service, an activity must be primarily for the benefit of someone other than applicant. TMEP 1301.01(a)(ii). Therefore, operating a wheat farm, for example, for the purpose of growing, harvesting, and selling wheat for further manufacture, is not considered a wheat farming service under the Trademark Act because, although the manufacturers derive an incidental benefit, the farming activities primarily benefit the farmer. Farming activities must be rendered for others to be a registrable service.
